1. Introduction & Acceptance
Welcome to Dataflakes LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and any associated services (collectively, the "Service").
By creating an account, purchasing access, or otherwise using the Service you agree to be bound by these Terms and our separate Privacy Policy. If you do not agree, do not access or use the Service.

2. Scope of Services
2.1 We provide web-based, timed practice tests and detailed answer explanations for data‑engineering certification exams (e.g., Snowflake, Databricks, Azure).
2.2 Future enhancements such as analytics dashboards, performance tracking, or mobile access are deemed part of the Service once released.
2.3 We are not affiliated with, endorsed by, or sponsored by Snowflake Inc., Databricks Inc., Microsoft Corp., Google LLC, or any other certification owner.
3. Eligibility
3.1 You must be at least 18 years old and capable of forming a binding contract to use the Service.
3.2 The Service is intended for professional data engineers and is not directed to minors or K‑12 students.
4. Account Registration & Security
4.1 An account is required to make any purchase or access paid content. Registration currently supports Google single‑sign‑on only.
4.2 You are responsible for all activity that occurs under your credentials. Keep your login secure and notify us immediately of any unauthorized use.
4.3 You may access the Service from any number of devices, but you may not share, resell, or transfer your account.
5. Fees, Taxes & Payment
5.1 Access is sold on a one‑time purchase basis; no subscription is offered.
5.2 Payments are processed exclusively through Stripe; we do not store full card data.
5.3 You may request a full refund within 7 days of your purchase. After 7 days, all sales are final. A substantial set of free practice questions is available for evaluation prior to purchase.
5.4 Listed prices include any applicable VAT / sales tax unless stated otherwise. You are responsible for all other taxes, duties, or fees.
6. Intellectual Property & License
6.1 All questions, explanations, text, graphics, software and other materials ("Content") are 100% original works owned by Dataflakes LLC and protected by U.S. and international IP laws.
6.2 Upon payment we grant you a personal, non‑exclusive, non‑transferable, revocable license to access and use the Content solely through the Service for your individual exam preparation.
6.3 No Downloading, Printing, or Screenshots. You may not copy, reproduce, distribute, display, transmit, translate, adapt, reverse‑engineer, scrape, or otherwise use the Content except as expressly permitted.
6.4 Using any portion of the Content to train competing AI models or to create competing products is strictly prohibited.
6.5 User Feedback. If you provide us with any feedback, suggestions, or comments regarding the Service ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, display, distribute, modify, and exploit such Feedback in any way and for any purpose without restriction or compensation to you. You represent and warrant that you have all rights necessary to grant us such license.
7. Prohibited Conduct
You agree not to:
- No Affiliation. The Service is independent of Snowflake, Databricks, Microsoft, Google, and any other certification vendors.
- No Guarantee of Results. While our materials are designed to aid preparation, passing the official exam is not guaranteed. Performance depends on individual effort and factors outside our control.
- "AS IS." The Service and Content are provided "as is" and "as available." While we strive for accuracy, the Content is for exam‑preparation purposes and may not always reflect the most current exam versions or topics. We do not guarantee the accuracy, completeness, or timeliness of the Content. We reserve the right to update, modify, or remove Content at any time without notice. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.
- Availability. We do not warrant that the Service will be uninterrupted, secure, or error‑free.
- Maintenance. We may need to perform scheduled or unscheduled maintenance, which may temporarily interrupt access to the Service. We will endeavor to provide notice of scheduled maintenance where practicable.
8. Termination & Suspension
8.1 We may suspend or terminate your account immediately for: (i) non‑payment; (ii) violation of these Terms; (iii) fraudulent or abusive activity; (iv) requests by law‑enforcement or regulators; or (v) technical or security issues.
8.2 Upon termination your license to the Content ends and all user data will be permanently deleted.
8.3 You may close your account at any time. Closing your account does not entitle you to a refund.
9. Disclaimers

10. Limitation of Liability
To the maximum extent allowed by law, our total liability to you for any claim arising out of or relating to the Service is limited to one hundred U.S. dollars (USD $100).
In no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.
11. Indemnification
You agree to defend, indemnify, and hold harmless Dataflakes LLC, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.
12. Governing Law, Arbitration & Class‑Action Waiver
12.1 These Terms are governed by and construed under the laws of the State of Wyoming, USA, without regard to conflict‑of‑law rules.
12.2 Binding Arbitration. Any dispute will be resolved exclusively by final, binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Rules in Sheridan County, Wyoming, on an individual basis.
12.3 Class‑Action Waiver. You and Dataflakes agree that any claims may be brought only in your or our individual capacities and not as plaintiffs or class members in any purported class or representative proceeding.
13. International Use & Export Controls
You may not access or use the Service in violation of U.S. export laws or regulations. The Service is not offered to users in countries or territories subject to comprehensive U.S. sanctions (e.g., Cuba, Iran, North Korea, Syria, Crimea, Donetsk and Luhansk regions of Ukraine).
14. Modifications to the Service or these Terms
14.1 We may update these Terms or modify the Service at any time. Changes take effect immediately upon posting an in‑app banner or other notice. Continued use after the effective date constitutes acceptance.
14.2 If you do not agree to the amended Terms, your sole remedy is to stop using the Service and close your account.
15. Miscellaneous
- Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Dataflakes LLC.
- Severability. If any provision is found unenforceable, the remaining provisions will remain in full force.
- No Waiver. Failure to enforce any right or provision is not a waiver of such right or provision.
- Assignment. We may assign these Terms without restriction. You may not assign or transfer your rights without our prior written consent.
- Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, internet outages, or governmental actions.
